Лобізм в Україні: регулювати не можна заборонити

Abstract

В статті представлено аналіз процесу законотворчої діяльності щодо нормативно- правового регулювання лобізму та лобістської діяльності в Україні. Автором зазна- чено, що дискурс та процес законотворчості з цього питання триває з початку ХХI cт., що відповідає загальній тенденції в державах Європи та в ЄС. Зазначено, що підписання Угоди про асоціацію з Європейським Союзом, Європейським Співтова- риством з атомної енергії і їхніми державами-членами стало додатковим чинником в прискоренні Україною з 2016 р. діяльності щодо виконання зобов’язання сприяти процесу інституційної розбудови лобістської діяльності. Не меншу роль відіграють в цьому процесі рекомендації Групи держав проти корупції (GRECO), які Україна має виконати для позитивного проходження оцінювання внутрішніх реформ. В роботі зазначено, що в Україні визнання лобізму як інституту представництва інтересів зацікавлених груп, в тому числі груп громадянського суспільства, є критично низь- ким. Проблемою залишається переважання негативного сприйняття лобізму як корупційної тіньової діяльності. Не меншою проблемою є протидія самих суб’єктів лобіювання і інститутів щодо впровадження регулювання лобістської діяльності та впровадження Реєстрів лобістів. Водночас, вимоги громадськості щодо регулю- вання лобізму для досягнення прозорості процесу конкуренції інтересів зацікавлених груп та отримання інформації щодо процесу «realpolitik» залишаються нереалізо- ваними. В статті представлено авторську оцінку особливостей законопроєктів політико-правового регулювання лобістських практик. Зроблено висновок, що реко- мендації ЄС та GRECO, очевидно, сприятимуть прискоренню впровадження правил транспарентності в Україні. The article presents an analysis of the process of law-making regarding the legal regulation of lobbying and lobbying activities in Ukraine. The author states that the discourse and the process of law-making on this issue has been ongoing since the beginning of the XXI century, which corresponds to the general trend in European countries and the EU. It was noted that the signing of the Association Agreement with the European Union, the European Atomic Energy Community and their member states became an additional factor in accelerating Ukraine’s activities in 2016 to fulfill the obligation to contribute to the process of institutional development of lobbying activities. The recommendations of the Group of States Against Corruption (GRECO), which Ukraine must implement in order to pass the evaluation of internal reforms, play an equally important role in this process. The paper states that the recognition of lobbying as an institution representing the interests of interested groups, including civil society groups, is critically low in Ukraine. The problem remains the prevailing negative perception of lobbying as a corrupt shadow activity. No less a problem is the opposition of the lobbying subjects and institutions themselves to the implementation of the regulation of lobbying activities and the implementation of the Registers of lobbyists. At the same time, the demands of the public regarding the regulation of lobbying in order to achieve transparency in the process of competing interests of interested groups and obtaining information regarding the process of «realpolitik» remain unfulfilled. The article presents the author’s assessment of the peculiarities of draft laws on political and legal regulation of lobbying practices. It was concluded that the recommendations of the EU and GRECO will obviously contribute to the acceleration of the implementation of transparency rules in Ukraine.
