Abstract

Стаття присвячена дослідженню лінгвістичного аналізу правничих текстів англомовних країн та Украї ни. Основна увага приділяється специфіці мови права, її структурним та семантичним особливостям. Шляхом порівняльного аналізу розглядаються відмінності та схожості мовленнєвих актів у правничому дискурсі обох мов. Мовленнєві акти у правничому дискурсі мають цілу низку особливостей, що відрізняють їх від аналогічних актів в інших дискурсах. Вони відіграють ключову роль у формулюванні, інтерпретації та реалізації права, і їх правильне застосування є суттєвим для юридичної практики. Стаття включає результати аналізу на різних рівнях: лексичному, синтаксичному, прагматичному, дискурсивному, семантичному та когнітивному. Лексично синтаксичні особливості правничих текстів відображають потребу в чіткості, точності та однозначності у юридичному мовленні. Вони допомагають правильно інтерпретувати законодавчі інтенції та забезпечують, що право буде застосоване консистентно та справедливо. Прагматичний аналіз правничих текстів розкриває, як мова використовується для досягнення конкретних цілей в конкретних контекстах. Тексти не лише переда ють інформацію, але й взаємодіють з читачем, намагаючись переконати його, вказати на певні обовʼязки або права, або інформувати про певний юридичний стан чи ситуацію. The article is devoted to the study of linguistic analysis of legal texts in English-speaking countries and Ukraine. The main attention is paid to the specifics of the language of law, its structural and semantic features. The differences and similarities of speech acts in the legal discourse of both languages are examined through comparative analysis. Speech acts in legal discourse have a number of features that distinguish them from similar acts in other discourses. They play a key role in the formulation, interpretation and implementation of law, and their correct use is essential for legal practice. The article includes the results of the analysis at various levels: lexical, syntactic, pragmatic, discursive, semantic and cognitive. The lexical and syntactic features of legal texts reflect the need for clarity, precision and unambiguity in legal speech. They help to correctly interpret legislative intentions and ensure that the law is applied consistently and fairly. The pragmatic analysis of legal texts reveals how language is used to achieve specific goals in specific contexts. Texts not only convey information, but also interact with the reader to persuade him or her, point out certain obligations or rights, or inform about a particular legal state or situation. Discourse analysis of legal texts allows for a deeper understanding of how language practices shape and reproduce social relations, identities, and power structures. Semantic analysis of legal texts provides a deeper understanding of how legal concepts and information are expressed and structured in language. Knowledge of these features of semantics is critical to the proper interpretation and application of legal texts. Cognitive analysis reveals how language structures and tools interact with the psychological processes of perception, thought, and memory. This opens up a deeper level of understanding of how legal information is presented, structured, and interacts with the recipient. Taking these cognitive processes into account can be useful for improving the quality and effectiveness of legal communication. Computer-assisted analysis of legal texts can automate and optimise a large part of the analysis process, which can be especially useful when dealing with large amounts of data. The use of modern tools and technologies for text analysis can help lawyers, researchers, and other professionals effectively identify key themes, terms, and concepts, and extract valuable information from texts. The conclusions focus on the cultural and historical peculiarities of legal discourse in Ukrainian and English, and the article also outlines possible areas for further research.
